Rescue Online Terms and Conditions


Rescue Online User Agreement You (the user) can access www.rescueonline.co.uk ("the site"), subject to the terms and conditions of use, as changed / updated from time to time entirely at the discretion of Rescue Online International, ) as set out below. This Agreement is for an indefinite term and you understand and agree that are bound by such terms till the time you access this site.

Changes
We reserve the right to add to or change/modify the terms of this Agreement including but not limited to suspend / cancel, or discontinue any or all channels, or service at any time without notice , make modifications and alterations in any or all of the content, products and services contained on the site without prior notice.

Copyright and Trademarks
Unless otherwise stated, copyright and all intellectual property rights in all material presented on the site (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on this site are the property of Rescue Online Ltd, its parent, affiliates and associates and are protected under applicable United Kingdom laws. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.

All the contents of this Site are only for general information or use. They do not constitute advice and should not be relied upon in making (or refraining from making) any decision.   Pay on Use Services

If we are instructed to appoint a contractor to attend a vehicle breakdown, you appoint Rescue Online Ltd herby known as “ROL” as us as your agent. You acknowledge and agree that this gives rise to a contract between yourself and the appointed contractor. Your remedy in respect of any act of omission or negligence of the service provided by the contractor shall be against the contractor and not ROL.ROL do not exclude liability for death or personal injury caused by the contractors negligence however ROL will accept no liability for any loss of profit, loss of business loss of contract or any indirect consequential losses, acts or omissions.

By instructing ROL to appoint a contractor, you authorise ROL to incur charges to the amount guaranteed (as set out in the terms and conditions ----) which you agree to pay on demand

Where you make an advance credit/debit card payment, this payment is an estimate of the total charges and you agree to accept that this amount may exceed the total charges only the amount chargeable for the work done will be taken from the advance payment. Where additional payment authorisations are required, ROL will endeavour to contact you to provide authorisation for the additional charges. In default of which you authorise ROL to incur charges of up to £500 in excess of the advance payment or authority provided.

If you have not settled any outstanding payments by the due date and/or have exceeded your agreed credit limit, ROL have at our discretion, the sole right to withdraw services to you until such outstanding amounts have been paid in full.

Charges will be set out in our rates schedule available at rates@rescueonline.co.uk which change from time to time. Upon instruction of ROL (or through use of the ROL Incident Management Software) to appoint a contractor, you agreed to the prevailing rates at the time of appointment and invoices to you are subject to the ROL charges prevailing at the time of appointment.
   
6. You may be invoiced in a number of parts.

ROL will not authorise any work to be carried out by a contractor on any commercial vehicle that is unattended. Should nay vehicle be unattended upon arrival, you will incur charges applicable up to the minimum guarantee provided by you.

Unless otherwise stated, all charges exclude VAT, IPT and any other national or international taxes imposed on the cost of supplying service or parts which shall be payable at the prevailing rates.
   
9. We do not guarantee to provide any services in the event of Force Majeure.
   
10.
Any services and/or repairs carried out roadside to a vehicle shall be considered temporary only and sufficient to enable the vehicle to journey to the nearest point of repair where a permanent repair should be carried out prior to further use of the vehicle.
   
11.
ROL will not be liable in any circumstances for any infringement whatsoever caused of any manufacturers or dealers warranty as a result of services provided.
   
12.
The laws of England and Wales will apply to this agreement and any claims must be brought before English courts.
